Master Services Agreement (MSA)

Uptime Target
99.95% monthly target with service credits per our SLA.
1. Services
We will provide hosting, email and related services as described on our website and order forms. Specific plan features and limits apply to each product.
2. Term & Renewal
Terms are month‑to‑month or annual unless stated otherwise and renew automatically until canceled.
3. Fees & Billing
Fees are due in advance. Invoices not paid by the due date may result in service suspension. Taxes and third‑party license fees may apply.
4. Customer Responsibilities
You are responsible for content, backups, account security, and compliance with this Agreement and the AUP.
5. Data Protection
We process personal data in accordance with our Privacy Policy. You agree not to store sensitive data unless appropriate safeguards are in place.
6. Suspension & Termination
We may suspend or terminate services for non‑payment or violation of the AUP or applicable laws.
7. Warranties & Disclaimers
Services are provided “as is” except as stated in the SLA. We disclaim implied warranties to the extent permitted by law.
8. Limitation of Liability
Our aggregate liability will not exceed the fees paid by you in the three (3) months preceding the event giving rise to the claim.
9. Indemnification
You agree to defend and indemnify us against claims arising from your content or misuse of the services.
10. Governing Law
This Agreement is governed by applicable local laws where Ebihost operates unless otherwise required.
Acceptable Use Policy (AUP)
Prohibited uses include: sending unsolicited email (spam), hosting malware or phishing, illegal content, resource abuse, or actions that negatively impact other customers.
Bulk email requires prior approval and compliance with anti‑spam laws.
CPU, memory and IO usage must be reasonable for shared environments.
We may throttle, suspend or terminate accounts that violate these rules.
Service Level Agreement (SLA)
We target 99.95% uptime per calendar month. If availability falls below this, you may request service credits within 10 days of the incident.
